While Robert Rodriguez‘s Machete Kills may have completed production, it still lacks a release date. It was expected that the film would hit theaters late next year, but producers who are filing a lawsuit against Rodriguez may prevent that from happening.

Open Road had picked up the distribution rights for the film last month, but a lawsuit filed by Overnight Productions against Rodriguez and his Quick Draw Productions could block the release. According to Deadline, the producers of the film are “seeking to terminate the April 2012 agreement in which they granted director/producer Rodriguez the rights to make another action movie about the rogue Mexican Federale. The rights would revert back to Rick Schwartz’s Overnight. The plaintiffs are seeking $2 million in damages.”

Overnight says they did not receive the Texas tax-credit information from Rodriguez’s company. These fees would help determine the fees owed to Overnight executive Rick Schwartz. According to the report, the company is owed an estimated $250,000. As a result of this lawsuit, Overnight is threatening to cut ties with Rodriguez and his production company, which would then in turn stall the release of this movie.

The first Machete only took in $44 million worldwide, but was enough of a critical hit that Rodriguez decided to move forward with producing a sequel. Danny Trejo returns to play the title Mexican vigilante. Charlie Sheen, Lady Gaga, Jessica Alba, Amber Heard, Sofia Vergara, and Alexa Vega also star.
