Because Marvel Studios doesn’t own the rights to X-Men, Fantastic Four, or Deadpool, and Fox doesn’t own the rights to any of the Marvel Studio characters, they are not free to use them in any way for their respective films, although Quicksilver and Scarlet Witch have a complicated copyright that allows the two characters to appear in a Marvel and Fox films (not played by the same actors of course). Even with that sort of loophole in play, many wonder what would happen should the rights revert back to Marvel. We got a small glimpse of what happens when studios decide to share their characters when Marvel and Sony inked a deal that allowed Spider-Man to appear in the MCU early last year.
However Fox doesn’t seem to be interested in making a similar deal – most likely because the X-Men film franchise is a successful one and they met the Fantastic Four deadline that allows them to keep the property for another few years. But that isn’t stopping Marvel from making contingency plans to fit those characters into the MCU should the rights revert back to them. More on the story below.
